1) Rent Control Basics

State Rent Cap (AB 1482 — Tenant Protection Act)

Maximum Annual Increase: 5% + local CPI OR 10% total per 12 months — whichever is lower1

Notice Requirements:2

  • 30 days written notice for increases ≤10%
  • 90 days written notice for increases >10%

Exemptions May Apply:1

  • Properties built after February 1, 1995
  • Single-family homes under certain ownership conditions
  • Units already covered by stricter local rent control
  • All exemptions must be properly documented and disclosed in writing

Local Rent Control (Oakland, Berkeley, Emeryville)

2) Security Deposit Limits & Rules

Maximum Amounts (AB 12 — Effective July 2024)3,4

Standard Cap: 1 month’s rent for most residential rentals (furnished or unfurnished)

Small Landlord Exception: Up to 2 months’ rent IF landlord owns:5

  • No more than 2 properties
  • Total of 4 or fewer units
  • Active service members still capped at 1 month

What’s Included: Pet deposits, key deposits, cleaning fees — ALL count toward the cap4

Allowable Deductions6

Landlords may only withhold for:

  • Unpaid rent
  • Repairs for damage beyond normal wear and tear
  • Cleaning to restore unit to move-in condition

Cannot deduct: Normal aging, faded paint, worn carpets from regular use6

21 days after tenant moves out, landlord must provide:

  • Remaining deposit (or full refund)
  • Itemized statement of any deductions
  • Receipts/invoices for repairs

AB 2801 Photo Requirements (Effective April-July 2025):8

  • Photos immediately after tenant moves out (before repairs)
  • Photos after repairs/cleaning completed
  • Photos at move-in for new leases starting July 1, 2025

Penalties for Non-Compliance: Up to 2x the wrongfully withheld amount + attorney fees6

3) Landlord Entry Notice Rules

Basic Requirements (Civil Code §1954)9

Standard Notice: 24 hours advance written notice required

Notice Must Include:9

  • Purpose of entry
  • Date of entry
  • Approximate time (during normal business hours: typically 8 AM–5 PM weekdays)

Allowed Reasons for Entry:9

  • Emergency situations
  • Make repairs or improvements
  • Show unit to prospective buyers/tenants
  • Conduct inspections
  • Court order

Emergency Exceptions9

No notice required for genuine emergencies:

  • Fire, gas leaks, burst pipes
  • Structural hazards requiring immediate attention
  • NOT routine maintenance or minor leaks

Abandonment: Formal 14-day + 18-day notice procedure required before entry without consent9

4) Just Cause Eviction Requirements

When Just Cause Applies (AB 1482)1,10

Protections apply after tenant has lived in unit ≥12 months (or 24 months if multiple tenants)

At-Fault Just Causes:10

  • Nonpayment of rent
  • Lease violations
  • Nuisance or illegal activity
  • Refusal to allow lawful landlord entry
  • Unapproved subletting

No-Fault Just Causes:10

  • Owner or family member moving in
  • Substantial renovations requiring permits
