What it requires

  • End a tenancy only for a listed cause, such as nonpayment, a substantial lease violation after a warning, damage, nuisance, denial of access, owner or relative move-in, permitted major repairs, or an Ellis Act withdrawal.
  • Nonpayment is not a ground if the amount demanded is less than one month’s HUD Fair Market Rent for a unit of that size.
  • The termination notice must state the cause and say that advice is available from the Rent Adjustment Program, with its phone and email. Owner move-in and repair notices need a current Business Tax Certificate and more.
  • File a copy of the notice with the Rent Board within 10 days of serving it.
  • Covers most rental units, including single-family homes and condos; buildings newly constructed within the past 10 years are exempt.

Owner checklist

  • Rent Registry current before serving any notice
  • Written warning to cease served first where required
  • Arrears checked against the current HUD Fair Market Rent
  • Required statements and certificate included in the notice
  • Copy filed with the Rent Board within 10 days

What changed and what’s next

  • Oct 1, 2026: Nonpayment thresholds drop with HUD's FY 2027 Fair Market Rents (1BR $2,290, from $2,385)
  • Expected Oct 1, 2027: HUD FY 2028 Fair Market Rents take effect, changing the nonpayment threshold

From our East Bay files

The just-cause error we see repeatedly is a self-managing owner of a newer single-family rental who assumed Oakland's rules didn't apply. A notice served without valid just cause is void from the start. We also track the current relocation amounts for every no-fault notice we manage, because the figures change.
