What it requires

  • File the annual declaration and pay the business tax by March 1, at $13.95 per $1,000 of gross rental receipts. A new rental must register within 30 days of starting.
  • On a rent-controlled unit, a rent increase that includes banking must come with a copy of a current certificate. A CPI-only increase may instead include a signed payment plan for delinquent tax.
  • Without a current certificate, a tenant can petition to contest an increase, and the owner can’t file or answer a RAP petition.
  • Owner move-in, relative move-in, and substantial-repair termination notices must include a copy of the certificate; lacking one is a defense to the eviction.
  • Some owner-occupants are exempt, such as owners renting one or two rooms in their home, or living in one unit of a duplex, triplex, or home with ADUs, if household income is at or below 150% of AMI and they own no other Oakland rental.

Owner checklist

  • Declaration filed and tax paid by March 1
  • Certificate copy kept for every rent increase notice
  • Certificate attached to any owner move-in or repair-based notice
  • New rental registered within 30 days
