What it requires

  • An owner move-in notice must name the intended occupant and their relationship, and tell the tenant they may request proof. Qualifying owners are natural persons with at least a 25% recorded interest, or certain family-held, trust, LLC, or partnership owners.
  • The occupant must move in within 90 days and live there 12 consecutive months. If not, offer the unit back at the same rent and terms and reimburse moving costs beyond any relocation paid. The ground isn’t available if the occupant already lives on the property or a similar unit is vacant.
  • A substantial remodel means permitted work on structural, electrical, plumbing, or mechanical systems, or hazardous-material abatement, that requires the tenant to leave for at least 30 consecutive days. Cosmetic work doesn’t qualify.
  • The remodel notice must include the required re-rental statement, a description and expected duration of the work, and a copy of the permits.
  • An owner who violates these rules is liable for actual damages, possible attorney’s fees, and up to three times damages for willful conduct.

Owner checklist

  • Name the occupant and relationship in the notice
  • Attach permits to any remodel notice
  • Calendar the 90-day move-in deadline
  • Keep proof of 12 months’ occupancy

What changed and what’s next

  • Apr 1, 2024: SB 567 owner move-in and remodel rules took effect
  • Expected Jan 1, 2030: Civil Code 1946.2 is set to be repealed unless extended

From our East Bay files

We treat owner move-ins as high-scrutiny cases, especially in Oakland. We've seen owners move in briefly, move out, and re-rent at a higher rate, which is exactly the fact pattern that triggers a wrongful eviction claim, so we walk owners through the requirements before they do anything else.
